WOTUS Impact Testimonial Form
NAHB fought for a favorable outcome in the Supreme Court’s ruling in Sackett v. EPA. We were successful because we convinced all nine justices to eliminate the vague and problematic “significant nexus test.”
Now, the EPA and Army Corps of Engineers (Corps) are enforcing their conforming “waters of the United States” (WOTUS) rule. To strengthen our advocacy efforts, NAHB is seeking information on how Sackett and the recent WOTUS rule have directly impacted your business.
To help us get a better sense of the impact on the home building industry, we are asking NAHB members to share testimonials highlighting areas such as:
- The percentage of your projects impacted by WOTUS.
- If you have gone through the preliminary jurisdictional determination (PJD) or the approved jurisdictional determination (AJD) process, how long it has taken to receive your PJD or AJD, and subsequent CWA 404 permit.
- Any features (i.e., relatively permanent, continuous surface connection, adjacent wetlands) that have been identified on your property, and whether or not these identifications appear to be consistent with the Sackett ruling.
- Any additional feedback regarding how the Sackett ruling is being implemented in your area and its impact on your business.
